Attached for your review and reference is information related to NIOSH Occupational Exposure Banding Process being proposed to modernize the criteria for OEL and to update those OEL’s considered to be out of date. This is an important process which has potential to impact our industry. Thank you to Larry Halprin at Keller and Heckman for bringing this to the VI’s attention.

The attached Federal Register notice indicates the public comment period on the draft guidance will be open until June 13, 2017 and a public meeting will be held on May 23rd. Please forward this to the appropriate individuals within your organizations to be sure their interests are communicating along with VI’s comments. The attached draft NIOSH Occupational Exposure Banding Process seems likely to be of interest. It is the 2-tier NIOSH effort (based on the character and quality of the available qualitative and/or quantitative data) to establish suggested OEL ranges for hazardous chemicals for which there is no OEL. It might also be considered in situations where an existing OEL is viewed as out of date. It is the anticipated follow up to the attached 2009 NIOSH control banding literature review, and seems to have been issued at a time when the immediate future of the OSHA PELs process is highly uncertain.

A public meeting is scheduled for Tuesday, May 23, 2016, and the comment period ends June 13, 2017. Please let us know if we can be of assistance.
